The Govt. of Orissa, in Department
of Energy, in letter dated. 16.3.2006 regarding the
applicability of the Right to Information Act, 2005
to all the distribution companies, informed that, the
Distribution Companies fall within the definition of
the " Public Authority " as defined in the
Right to Information Act, 2005.
This has been challenged by CESCO (now CESU) before
the Hon'ble High Court of Orissa, Cuttack, in W.P.(C)
No. 11976 of 2006 and after hearing by order dated.
28.3.2007 the Hon'ble High Court has been pleased to
stay the operation of the letter dated. 16.3.2006 of
the Govt. of Orissa, in Department of Energy .
